ONLINE DISPUTE RESOLUTION

Subject at all times to the relevant product and service terms, all disputes arising as a result of the use of our website, or pertaining to the interpretation of these conditions or on any matter which, in terms of the conditions, requires agreement between the user and us will be submitted to and decided by arbitration.

The arbitration will take place at our Head Office in Otjozondjupa, where only Kambaku Hospitality College CC (and our representative) and you (and your representative) may be present.

One arbitrator shall:

• For primarily legal matters: Be an impartial admitted legal practitioner or advocate of not less than ten (10) years standing
• For primarily accounting or financial matters: Be an impartial auditor of not less than ten (10) years standing, and be agreed upon between us. Failing agreement within 5 (five) business days of the arbitration being demanded, either of us shall be entitled to require the appointment of an arbitrator by the Chairman for the time being of the Society of Advocates (Windhoek) who, in making his/her appointment, shall have regard to the nature of the dispute in question

The arbitration shall be conducted pursuant to the rules laid down by the arbitrator, provided that such rules result (if practical) that the arbitration be completed within 30 (thirty) business days after it shall have been demanded. The arbitration shall be conducted in an informal manner but nonetheless in accordance with the provisions of the Arbitration Act, Act 42 of 1965 (as amended). The arbitrator shall be entitled to dispense with the rules of procedure and discovery, to the extent that he/she deems this necessary so as not to delay the expeditious conclusion of the proceedings, but he/she shall observe the rules of evidence.

In no case shall the user have the right to go to court or have a jury trial. Further, the user will not have the right to engage in pre-trial discovery except as provided in the rules; the user will not have the right to participate as a representative or member of any class of claimants pertaining to any claim subject to arbitration; the arbitrator’s decision will be final and binding with limited rights of appeal. We and the user both undertake to keep the evidence in the arbitration proceedings and any order made by any arbitrator confidential unless otherwise contemplated.

The prevailing party shall be reimbursed by the other party for any and all costs associated with the dispute arbitration, including attorney fees, collection fees, investigation fees, travel expenses.
